rights for those with asylum

would anyone know what would happen if a person that has asylum marries a person (on a visa or undocumented) from the country they are running from? since they aren't a resident yet, i guess the finacee visa is out of the question. i guess they can alwasy married, but what about having the spouse being able to stay legally? would anyone know? thank you.

and how long will that person be able to go back tyo the country of origin? could they return w/o a problem after they become a resident or citizen? or do they have limits?

If the "asylee"' marries that person BEFORE the asylum GETS APPROVE, the "new wife" can get derivative asylum; therfore, stay in the US legaly.

IF the "asylee" marries that person AFTER the grant of the asylum, THERE IS NOTHING IT CAN BE DONE, until the asylee becames LPR and can petition for the wife... which this process may take up to 4years... or wait until citizenship and petition the wife.

As of today there are no benefit for wifes/husbands of asylees, unless they were married before the asylum grant.

May best advise would be to wait until the asylee becames LPR and file for a relative... then as soon as the asylee get his citizenship (if the LPR petition have not been approve yet) ... upgrade the petition filed to a relative of a USC and the wife would get her GC within months...

For the former asylee there are no certain/safe answer... some people prefer to wait until citizenship and some they have gone and came back to the US without problems... some have had issues at their citizinship interview for these travels... so I guess it all depends...

thank you. the thinking is that logic says that people ought to be together. hence, they can't go back where he would be persecuted. i guess he could always marry and have her out of status or go to a third country. they will check with ana ctual lawyer, but what you say sounds right and probably correct. thank you.
