I've got RFE from Regional DOL about prevaling wage. :mad:
I didn't speak to my lawyer yet, before doing this, to have more info for that conversation I'd like to ask people who got in the same situation. What YOUR lawyers think to be safer - make offered salary equals prevaling wage or submit alternative data proving that offered salary IS equal prevaling wage?

I concerned because my current salary significantly lower that the one "suggested" by DOL as a prevaling wage.

Are there any cases when LC has been approved after responding either way (offer raise/proving lower prevailing wage)?
 
Check for posts in the Maryland LC threads.
There are couple of them who got RFE's for wage.

From what I read was they accepted the raised salary, and advertised the job internally in teh company for 10days and sent the response and the case was approved.

Check - "MDGC" and "inshope" responses - they had gotten the queries but were approved.

Thank you for response.
The secretary just spoke to my lawyer and said she had no doubts about the solution - to increase offered salary. Second option (debating about prevailng wage) is too unsafe according to her...
