My labor certification is filed under the category of software engineer (DOT #030.062-010). I switched the job after 180 days of 485 application. Now I am working as a consultant in a consulting company. Today USCIS issued an RFE for EVL. I just checked the DOT categories and found that consultant has a separate number (189.167-010). But I DO software development work in the consultant company. My question is if my company lists the job title as consultant and explains that I do software development in the job description, can this be considered as "same or similiar job function"? Will I have any trouble by the title? Could anybody share any experience? A million thanks!
 
Hi crystal,

U dont have to worry. Unless u are now in marketing/sales and your labor is for software u dont have to worry. If at all ist possible in the evl list your duties to match exactly whats mentioned in the labor applicatiion. U will be ok. Can u please post your deatils like ND/RD etc

Thank you so much for your warm reply. My RD/ND is 12/30/2002. Actually I just got from online message that an RFE was issued yesterday. I haven't received it so I don't know the detail yet. But I guess 99% will be EVL. I sincerely bless your case can be approved soon :)

You dont have to worry as my case was also AC-21 and was approved yesterday (12/9/2004). My labor job title was "Programmer Analyst" but my new job title was "Senior Systems Engineer" and salary was twice the labor salary. I submitted EVL from new employer that says like "This is to verify our offer of fulltime permanent position to Mr.X as Senior Systems Engineer, the job duties of the position being similar those of a Programmer Analyst......".

Make sure that the job duties that you have to mention are same or similar to those of labor and you should be fine.
 
Hi Crystal,

U dont have to worry. Your job desc as stated in your posting is more than convincing that u are doing a very related job. If u have changed jobs after 140 is approved and 485 has been pending for more than 180 days u are sure to get an approval. There are several postings in this forum about AC21. U can search AC21 and u can see and read several hundred postings .
