RFE while out of Country

Hi all

been a while since I posted.
Rcvd an email that an RFE has been issued on my spouse's 485.

LUDs on both our cases on Jan 24, and Jan 25th for spouse.

we are both out of the country and wont return until mid feb.

> will this pose any issues at our point of entry. we are using APs to reenter the US.

That is good news in a way, your file is under a set of eyeballs !

PD being current has nothing to with when a officer reviews your file. (pre-adjudication).

Actually the only thing I would like to know whether this is related to NC being clear or not.
 
Big Risk

You are taking big risk in the sense that they might have given only 3,4 weeks time to respond. You might want someone to open it and find out the details so that you can do your prep work.

Attorney is on it

My attorney shot me the email the same day I got the status update from USCIS. So looks like hez on my case.

Wont we have like 30 days to respond to the RFE?
It has been issued on Jan 25. and we are back in the US in mid Feb.

would the rfe have a response time of less than 30 days?

Also attorney's take on an RFE being issued when the applicaant's PD isn't current is coz USCIS does not want to keep issuing APs and EADs for people ineligible for AOS hence the preprocessing / weeding out of applications (before priority date being current )!
-- is that true???

His theory has me freaked out!!!
