RFE waiting and leaving country...

Hi,
USCIS received reply to RFE on 04/06. I was hoping to get responce before I leave for vcacation. As per plan I am leaving on 06/18 for 3 weeks. The RFE was for:
1) Emplyment Verification
2) BC for my wife
3) EAD compies. There was gap in EAD renewal, I worked close to 30 days while waiting for EAD to be approved. My lawer says since it is less then 180 days it should be okay.
I am worried about is there any chances it may be rejected bcs I worked without valid EAD?

If there is a chance that you don't go abroad... given that you had been on pay-roll without work authorization .... (I assume you are not on a H1-B Visa) it is better... Ofcourse.. this is not a professional legal advise.. this is from a perspective of "better to be safe than sorry"
