RFE spouse Medicals... Input please..

Hi..

I have finally recv'd my RFE yesterday. Followinag are the requests:

Myself:

1. Employment letter from Employer.

Spouse:
1. When she did Medical on 05/15/2003. That nurse/Doctor messed up the forms it seems and form I-693 is not included with her medicals (I think it is that Vaccine, Now BCIS wants her to submit all her medicals again.

My question is she is 7 weeks Pregnant now, is there a way I can avoid this Vaccine in her new medicals?! If you know any info, your input is very much appreciated.

Yes!! Your wife can avoid taking vaccine. Infact, the INS authorized doctors are aware of that.

Explain your situation,they should be able to draft a letter explaining your wife cannot undergo vaccine at this stage. But I guess she may need to undergo other test.

Could you post the actual message contained in the RFE?

Form I693 is the entire Medical Examination form - and not just the vaccination part. I am sorry, but it looks like the complete form (the sealed envelope itself) got lost somewhere.

From what I understand from your posting, you may be able to go back to the same doctor where you did your medicals and get a new I-693 filled up. They may still have copies of your records, including vaccination information, from your first visit. Your wife may not need any new vaccinations now. She may have to undergo tests though.

If the mess-up is indeed the doctor's fault, you can complain to USCIS. It would be the doctor's fault if he had given you an empty envelope, or a partially /incorrectly filled-up Form I693 or not given you a test that he should have.

I am not a doctor - and certainly not a lawyer. Consult your wife's doctor if any vaccinations are needed now. As per USCIS website (under FAQs), they say the following:

"If you are pregnant, you are required to have a medical exam, but some parts of it may be postponed until after delivery of your baby, depending on the circumstances of your case. If you have any concerns, you should discuss them with your family doctor before the medical exam, with the Civil Surgeon, or with the Panel Physician. "

Talk to your immigration lawyer as well. I guess that goes without saying...

Thanks for your response, I am contacting an INS Doctor here in Denver, CO. When we did the medicals initially we were in Portland, OR. I don't think I can chase up with the doctor in Portland, RFE for my wife's says that certain portions of I-693 was not filled by the doctor/nurse. I am still waiting for my lawyer to send me the RFE so that I will get an idea of what is going on..

Is the RFE comes to you or to your lawyer. Today i got emails that i will be getting some kind of RFE. Please do let me know....
 
RFE will be sent to the Lawyer. Only NOID will be sent to both applicant and Lawyer.

So you have to wait for your lawyer to get your RFE.

My Lawer got the RFE on 10/25/04.. it took like 9 days from Vermont to Boston, my lawyer faxed me the copies..
