I got an RFE for both: :(
1. Company’s ability to Pay and
2. Education evaluation

Frustrating thing is that, basically I-140 is for only two main things: Company’s ability to pay and your Education evaluation and when you get RFE on both of these cases you think daaaaaaaamm!!! :mad: I am surprised how my lawyer has prepared my case (especially when my company is doing really well and I have more qualification what it is required in Labor as in my case :mad: )

Can anyone tell me what is the best institute or agency that USCIS recognize for doing education evaluation? :confused:

Any way in short ....just wanted to give you guys a message that you do a lot of research before hiring a Lawyer for your case.

Yup.. trustforte it is ..

Provide the exact wording of RFE and also of the Labor ( every column that pertains to education and experience).

I am surprised as to how can they send a RFE when the Labor was filed for u ... and not a Subst Labor.

Exact wordings of my RFE:
1. Submit conclusive evidence that will prove that the organization has the ability to support the applicant in addition to the number of individulas currently receiving compensation and other operating expenses. You must submit evidence such as copies of employer's federal tax returns, audited financial statemaents or annual reports......and so...
2. The ETA-750 labor certification requires a bachelor's degree or equivalent in computer science, engineering or related. Please submit evidence that the beneficiary possesses a qualifying degree from a united states college or university or submit a credentials evaluation that finds the beneficiary's foreign education equivalent to the required bachelor's degree
 
I agree with Genius04, the ability to pay RFE is a standard practice for large companies if they have filed lot many GC applications lately.

The education RFE must be because your edu. eval may be a 2-3 liner saying that this degree is equivalent .. blah.. blah...

USCIS nowdays wants detailed edu eval ... for example see the attached education equivalency between electronics degree from India and CS degree from US university.
