RFE response....

Strange thing happened with my case. According online/phone my status changed to RFE on Aug 4th. Since then I have been in constant touch with my lawyer. They kept saying that didn't receive the RFE notice. I even called my employer and he spoke to the lawyer last Tue/Wed about my case. It seems my employer was also told by the lawyer that they are still waiting for the RFE notice. I was actually planning to call my lawyer this monring to decide on the next course of action as 14 days have passed and still didn't receive the notice.

This monring I was checking my wife's status which still hasn't changed from FP message. What the heck I thought I would check mine also(It has become like a routine thing). Guess what... it says RFE response received on Aug 18th. Exact message below.

I was shocked and worried little bit. I don't know what is going on here. I had my tax papers, paystubs everything ready. Something is happening behind the scenes. In my case I am paying for my GC and the employer(??!!) just to use his company name for billing purposes. I pay him certain percent for this. I am confused here...:confused: :confused: :confused:

Besides that is the following message normal when RFE response received. Even the phone message is the same...


On August 18, 2003, we received your response to our request for evidence or information. It is taking between 365 and 540 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case.

I've seen this before on this forum. It probably has to do with security check. The RFE is internall. They put a request to their or FBI security system and the status changed to RFE. When the result came back it changed to RFE received.
It probably also means ypu aprooval is around the corner.

Or it might be possible that your employer/lawyer is doing something behind the scenes. Not to scare you though.

I just talked to my lawyer and it sounds like they never got the RFE notice and when I told them about my status change that occured this morning they were surprised. So I have faxed them the status page (from the web site). Lawyer told me that he is going to call the BCIS and find out.

On the other hand I doubt my employer (oneman desi show) would do something behind the scenes. Reason is my company is a small desi company (may be 10 or 15 guys work for him). I work on hourly basis where I give him certain percent on the billing. I am responsible for marketing myself, deciding/negotiating billing rates, H1, GC etc. He keeps begging me to find new guys to join him so he can make few $$$. I am going to call him and find out anyway.
