RFE Response Time?

Hi all !

I'm new to the forum and find it very informative.

I got an RFE for my I 140 two months back.I found it online on
the 11th of dec 2004 and we received the notice from the INS on
the 20th of dec. I was told by my lawyer that they would send the
response within a span of 10 days from today.

My concerns are :


1. How long would the INS allow to respond ? what is
the maximum time given by the INs ?

2. Which date would be taken into account ? Would it be
the date updated online or the date we received the
query in hand ?


Any advice is highly appreciated.

Selvam,

in most of thee cases INS is very quick in responding to RFE's. They approved my 140 in less than a week after they received the reply to my RFE.
 
Can RFE be responded by petitioner without attorney

Hi,
My I-140 got an RFE(company's ability to pay). The attorney actually sent all the financial documents when the petition was applied. Still there was an RFE. Now, the company(petitioner) does not want to pay the attorney for RFE response(attorney asking $750). Can the company representative(petitioner) reply to the RFE without an attorney?
Help and please respond anyone who knows as I am waiting on this to get the RFE responded.

My response time for RFE is 1st week of mar 2005.
The USCIS asking 2002/2003/2004 Tax statments of my company. My company is not willing to do tax return for 2004 at this time, due to some other reasons. My lawer told me , he is going to send the response with out 2004 tax return.

what will happen, will USCIS deny my case or not.

Hi All,
I haven't yet received any of your opinions on this. Can the petitioner respond to the RFE without an attorney?
 
Pay it yourself!!

I do not know if they will accept it. I think there is a fair chance that they will deny that, as the I-140 application is filed by the employer.

If I was in your situation, I will ask the lawyer to file the RFE, and pay for it out of my own pocket!!

You can send in the RFE yourself or a company rep if you prefer. What you do need though is the original RFE letter and the envelope the reponce is to be sent in. Both of these the lawyer should have got. It must be sent in the envelope provided.

My RFE was sent on February 4th and my lawyer faxed it to me on Feb 16th.
My RFE says they need the responce NO LATER then April 29, 2005. If not submitted by the timeline they say they will consider your I-485 as being abandoned.

query in hand ?
It would be the date on line they said they sent it.


Any advice is highly appreciated.
