RFE requested need your help !!!!

Guys, I just received a RFE today. I need your help.
As per RFE notice it said.
Submit your Original birth certificate showing your parentage,which has been registered with the proper civil authorities of the country of your birth. The copy that you submitted is only a translation.

Submit a new translation of the birth certificate. The translator must certify that he/she is competent to perform the translation is accurate. Translations submitted without related foreign-language documents are not acceptable.
Original documents will be returned to you upon completion of your application.


Guy's now my question to all of you is I'm from a third world country where birth certificates are not issued upon birth like United States. Therefore while I applied for I-485 I asked my parents to help me by sending me a notarized copy (translated in English) from the city where I was born mentioning my date of birth, my parents name & current address etc.
As I asked my parents sent me exactly what I said & I submitted that copy with the application back in 2000.
Now what do they mean by this RFE? And what different Birth Certificate I could send USCIS now since as I mentioned earlier in my country they didn't have the system to issue Birth Certificate ( May be now-days) while I was born back in 1969 ?
Please help me folks. Got really nervous. I have to respond by March 31, 2006.

Is the copy of your birth certificate in your native language? Or was it already ISSUED in your country in English? Why does the IO say 'what you submitted is a translation'? The original copy should be actually an original document which establishes yoru place of birth, date, parentage. THis note should be issued by your local civil registry in your country and BASED on their data from 1969. It doesn't have to be the actual document (the hard copy) issued back in 1969, but it has to be a sort of a reconstructed birth note from your birth registry in your town. Also it needs to be notarized by a public notary in your country in their native tongue and state seal. The notary note should say that 'this copy is made in exact accordance with the original document and/or official archives..date..name..seal..etc'

Now, your translation. Is it also notarized? Does the translator say at the end of the translation 'This translation is performed by a competent translator Mr. So-so. It is accurate, in accordance with the original and performed to the best of my knowledge and ability...etc.' This kind of statement MUST accompany your translation and the translator should sign this in front of, again, a public notary.

Also, make sure the translator translates everything, including signatures, seals, words like 'duplicate, replacement'

This is from my experience of working in the immigration court where such documents were heavily scrutinized. You might want to talk to a lawyer as well.
 
don't panic!!!
just re-do the same thing ..but this time enclose the original document with the translation.
for back-up have your city clerk write a letter explain the matter...translate this letter also..and stay quit.
remember this is you last step before the green card..so be patient.

Your parent(s) need to provide an affidavit. Explain in a cover leter why you dont have a real birth certificate.

Atique, I didn't have a Birth Certificate either. I sent an Affadavit by my 2 uncles stating my DOB and that they know me as they are my real uncles. And in the letter, we also wrote "its not in the custom to issue birth certificats in XXXX" where xxxx is the home country.

Then Igot a RFI requesting for a birth certificate. So i went to my local embassy and they gave me a birth certificate. Its up to you if you want to get help from your embassy but usually a home country passport proves that you were born in that country and they can give you a real birth certificate.

Or do as they say and get the originial and google and get it translated by a pro, they also give you a certificate.

a suggestion!

pay close attention to what they requested in the following sentence:

"The translator must certify that he/she is competent to perform the translation is accurate".

i believe this is important that the translator attest that he/she is competent for the translation. so, make sure this statement appear on the document translated.

oops! didn't see that 14ksusha mentioned it above. but anyway this maybe the cause of requesting the translation again, who knows. just do as they ask and you will be fine inshallah

Dear Atique:

We Chinese could get a notary certificate with English version by Government notary department for birth certificate with steel stamp and water picture ( Tie An men Square's stone picture) in the middle of the paper ( like bank note, nobody can make it himself). Can you get that kind of document from your local government by your parents? A friend of mine's mother sent that notary ceritificate to INS and two weeks later, she got G/C.

I m from lahore........and i paid 500 RS to get my birth certificate in english and i was born in 1973...........try in ur city and pay them some money(urgent fee ;) ) they will do it in few hours.

Thanks bro, I noticed LUD change on 01/10/2006. Guess that's due to this RFE. Well, atleast looks like IO is going through my forgotten file & may be my freedom is close. What do you think bro? By the way Eid-Mubarak.

HI Atique, this latest LUD may be a positive news to you - they may approve you before your birth certificate arrival - from previous threads, anything can happen.

Did your derivatives' also have this LUD and RFE ?

My LUD is changed into Jan.10, 2006 today like you, bro. Are we close to see G/C?

Dear Atique, You are nervious. That is ok. My sister was in the same situation. when she was applying greencard, she submitted her birth certificate back in 2000. In 2005, they sent the same her the RFE as yours. She panicked. She didn't understand why they were requesting this birth certificate. She finally submitted a translation of her original document, and after a week she got approved.
Now in your case, Do not screw up. There are a number choices for you. The first one is get the original document with which you submitted with your first application. Translate it and submit. The second option is write them a letter explaining that you have submitted your birth certificate with your original application. It is posible that they have it on file, but have not yet looked at it. Another option is get two persons that know you. Take them to an notorizing office and have them sign an affadivit. These people have certain crateria, and this clear in the paper in which they for the evidence.

In all these sceranias, do not send them anything that would mismatch with your original birthcertificate. It is not really that difficult. I don't know the country that you are from, but they go very easy on birth certificates in most cases. They just want to have something on file for per adjudicator's safety. so respond this RFE as fast as possible and they will respond fast.........Good luck.....You days from approval. when you are mailing the RFE use express mail...............I like that...........the next day......... :)
