My I-485 is still pending and last month I've receive a RFE asking for a letter from my employer, all nonimmigrant status granted, all I-797s, a copy of US visa, I-94, I-20, and a copy of ID with photo. Also, it said that "If you are no longer employed by the I-140 petitioner and are requesting eligibility under the visa port. provisions of section 106(c) of the American Competitiveness Act, (AC21)... you must also submit the following info. :
- A list of employment history
- Form G-325A
- W2, Tax Statements, pay stubs, cancel checks, Form 1040
- Letter from the employer
My questions are:
1) I've been working for company A from 1997 to present (~7 years). My I-485 is still pending. I got a promotion from the same company in 2003 and have to moved from IL to CO. By the time I've moved it was over 180 days after I've filed my I-485. From what I understand I'm still employed by the same I-140 petitioner even though I've moved to another state. Am I right? Do I still need to provide additional info. that they were talking about requesting the AC21?
2) If I have to provide the INS with pay stubs, etc., how long (months, years) do I need to make copy?
3) When I was in college and university, I got a job on campus as a work study. I was told that if I got a job on campus I don't need an EAD. Is that true?
