just want your opinion on my case. I am a physical therapist applying for greencard. Unfortunately, I wasnt able to provide my visa screen for RFE. I received my certificate a week after the deadline for RFE. My paralegal said that it is possible that my case would be denied. according to him, I am not eligible to have a MTR. Please advise.

you might receive a second RFE, or your case might be denied. in case of denial, file a motion to reopen the case due to new evidence, in your case possession of visa screen.

hi,thanks for the enlightenment. the waiting iof response from INS is really making us nervous. We hope we could file again in case our application be denied.

if a I-485 is denied, how long are we allowed to stay in the US so as not to be considered out of status if you are to file for a motion to reopen the case? hoping for your reply. thank you!
