RFE question regarding my W2

Last week I received RFE regarding my 2001 W2. I have been employed since 2000 till todate with out any break.

I have two W2 for the year 2001 one from company A ( Jan - June 2001) and one from company B ( June - Dec 2001). I changed my job in June 2001 and joined company B and company B filled for my green card in Nov. 2001. And I gave both W2s to my lawyer.

My question is which W2 would USCIS look for ? company's A or company B. There is a siginificant amount of wage ( annual salary ) difference between A & B. Company A never filed for my green card.

I am concerned whether this would affect my i-140 petition.

Please advise. Please post your expreinece who had/were in similar situation.

Hi,

CIS generated RFE for my I-140 on April 5. I have not received it until May 3...

it asks for establishing the employer had ability to pay ..

"submit company's 2000, 2001 tax return

as an alternative submit 2001, 2001 company financial statements

Or if the beneficiary was employed by you in 2000 and 2001, submit copy of W-2 form and tax statements showing how much the beneficiary was paid by your business."

I started to work for my current company in 2000 and I have 3 w-2 forms for that year ( two from other companies). My attorney asks me to submit w-2 from for my current company only because that's the only one matters.

in your case, What exactly your RFE says?

Follow is the excerpt

"Please submit the evidence the beneficary ( me) was being paid the proffered wage on november 2001, the filling date by submitting a copy his W2 wage and earnings statement for 2001"

Thats what it says pretty much.

I think only w-2 for your Green card sponsor company matters. In the sentence "submit evidence the beneficiary was being paid the proffered wage", proffered wage should mean wage paid by your sponsor company.

just my personal opinion.
