RFE on wife's AP renewal application

Hi,
I got my GC approved in June 2002 and my wife's I-485 application is still pending. Her RD is Feb. 2002. Her current AP expires in March 2003 and I had myself applied for her AP.

We received a RFE in the mail last night. Here's the actual text from the INS letter:

REQUEST FOR EVIDENCE - FORM I-131

Evidence of Eligibility: Submit a copy of your approval notice (Notice of Action, Form I-797) or receipt notice (Form I-797C) for Form I-140, or Form I-360, or Form I-526. If you have filed the I-485 as a derivative alien, submit your spouse's or parent's I797C for his/her I-485, AND the I-797 for his/her approved or pending I-140, I-360, or I-526.

Evidence Of Relationship: Submit a registered marriage certificate as proof of relationship. If you cannot provide te evidence of eligibility, please explain.


Since its been a long time since my GC has been approved I don't quite understand all these INS' technical language anymore. Can someone please explain in plain English what exactly are they looking for?

RFE for AP

I received a similar request a couple of weeks ago for my spouses AP. We provided the following documentation and got approval in 10 days over the holiday period.

Certified copy of Marriage certificate
Copy of my I-797C, Receipt Notice for I-485
Copy of spouses I-797C, Receipt Notice for I-485
Copy of my I-797C, Approval Notice for I-140

Did you Apply 485 at a later stage for your Spouse. ?

Can you post your Approval Date and the date you applied for your spouse?
