RFE on I-140

Hi All,

I got an RFE on company’s ability to pay.

Here is the background of my company:

No of employee: 2
Product Development Company
No of clients: 15 (including fortune 500 companies)
Revenue: $ 700k (2003)
$ 300k (2002)
$ 150$ (2004 till first quarter)

What are the chances of my case getting approved?

Applied for 140/485/EAD/AP in jan,'04.

As far as I know a number of employee doesn’t matter as long as your company is paying you and able to pay you in near future.

In my case, my employer has been paying me the salary mentioned in my labor

If ur employer is able to pay ur salary u may get a approval. What was the advertised salary in the labor? Is ur company showing profits? If so is it more than ur salary.

My friend had the same issue but he got approved.

My company paying the salaries to all of us regularly and as mentioned in the labour.
It seems that my company's financial records are also good.

I hope our greencard process will be done smoothly and quickly

Is anyone know how long it takes time to receive RFE by mail?

My online message is showing that USCIS issued RFE on my I140 application on Mar 30, 2004.

How long it takes time Approximate to get result after recieving RFE reply by USCIS? It's a dump question though. I like to know waht is USCIS rule to take action on RFE reply received?

My advertised salary is $80k, and my employer has been paying the salary mentioned in my labor.

We made a profit in 2002 which was more than my salary. But this is not true for 2003 (we didn’t make any profit in 2003). We also have $150k in our bank and some of our product deals are in final stage.
