My wife (primary applicant) got an RFE for her I-140 with a reason for company's ability to pay the salary stated on the Labor. (got a Labor substitution)
They have asked for company's financials, all her W-2's and recent paystubs.
The problem is that my wife got her H-1 in Nov 2001 (changed from H-4) but didnt start getting paid till sometime in 2002 as a result of which there is no W-2 for 2001. They have asked for W-2 for 2001, 2002 and 2003 and recent paystubs. I have the W-2 for 2002 and 2003 but not for 2001. Also have submitted recent paystubs.
Questions :
1. Can not having a W-2 for 2001 cause a major issue? Is there any letter we could give instead ?
2. For some reason, if this I-140 gets denied, will our approved EAD's be denied? The reason I ask is, myself (dependent) is on the brink of changing jobs using my approved EAD. Should I hold this option till I-140 gets approved?
