Hi All,
I got my I-129 Petition for Nonimmigrant Worker filed under the Premium Processing Program through the Texas Service Center and have received the following RFE:
The BCIS is asking for proof of at least three years of work experience to substantiate the claim that I am qualified for the offered position or any other Documentation to establish my eligibility for an H-1B Visa.
PLease note that :
1. I hold a Bachelors Degree in Chemical Engineering from One of the best Technology schools of India called Indian Institute of Technology, Kanpur.
2. I have about 1.5 years of industry experience in various emerging technologies like Tibco, SeeBeyond, etc.
3. I have worked in USA for three months on a B Visa for a Well Known Client called Agilent Technologies and have received excellent appraisals from the client for my work.
4. Many of my collegeous who have never worked on any project in USA and less significant degree than mine and have less experience than me have got their H1Bs approved without any RFEs.
Has my company's attorney messed up with my case ?
Please help me out with your advice and suggestions. I would appriciate if any of you find time to help me respond to this RFE.
