RFE on English Names - Are we going thru NC all over again?

Hi:

Both my wife and I got RFEs because we have our English names added onto our Chinese names. The Chinese names are spelled exactly the same, all we did was add the English name to the beginning when we immigrated to Canada some years ago.

We responded to the RFE with document trails of all the names dating back to birth and the lawyer said it should be sufficient. We also got an update saying the case processing has resumed.

My question is: Do they have to put the whole thing thru FBI NC again? How long would this RFE add to the process?

Paul,

You can easily check if your RFE put you back in the name check by scheduling an Infopass appointment. In any case, this probably shouldn't delay your case for more than a few months.

If you included your English name on your original application (form 485 and 325A), it is likely that USCIS already submitted them for Name Check. Note that since FBI checks various combinations and fractions of your names, it is possible that adding an English name could increase the odds of getting "hits." But if you used the name officially you need to report it, regardless of NC, so you did the right thing.

You can certainly go to an infopass and find out if they initiated another name check, as the person above mentioned.

I am confused... Why you did have to go through choosing English Name although you had your original name? Was it immigration related enforcement?
