RFE on education - I140

I got to know the RFE from my lawyer and it is on my educational evaluation. Somehow the officer at the CIS thinks that I have only 3-year degree which is not equivalent to BS in US. Actually I do have a 4-year Engineering degree with Electronics and Communication Engineering as my specialization.
CIS has the following documents with them already in regards to my education.
1. My degree certificate
2. My transcripts - covering all the 8-semesters in one page.

My lawyer asked me if I have the individual transcripts for all the semesters. I do have those in India but not here. At the end of my degree the university issued a Transcript covering all the semesters at the front page and description of all the subjects I had taken at the back side of the transcript.
When I enquired my classmates/friends they told me that they did not attach other document any different than mine.

Anybody in similar situation to share with me?
 
I too guess this is not 3 or 4 year degree issue. This is EB2 issue which should be in EB3.
Talk this with your lawyer.

Try to post the RFE wordings it self.So that people can analyze/suggest more precisely.
 
I just received a fax from my lawyer.
Here is the exact wordings.

IT appears that the beneficiary obtained his Bachelor's degree in three-
years. This is not equivalent to a US Bachelor degree obtained by a student
in four years.

Submit additional documentation that the beneficiary qualifies for the job
offer specified in your Application for Labor Certification (Form ETA 750A).
This documentation should show that the beneficiary has the required
education as of the time of filing this pettition, September 7, 2001.

What do you guys think? Isn't this odd RFE?
 
It should be easy to handle. Get all the transscripts of all four years from India and send them.

I am afraid that I can't get all these transcripts at the moment. Is there any alternate solution?

You must have gotten a foreign education evaluation? The h-1b foreign education evaluation is what you must have submitted with the 140?

If you submitted the foreign education evaluation what did it say?

Also, on the 140 I believe there is an area where you specify all the schools you attended and dates. Could it be that even though you went eight semesters, the total time in calendar years was three. If that is what it is then it may be confusing the immigration officer.

I would suggest getting another foreign education evaluation.

My lawyer said to me that she had done the educational evaluation during the labor in 2001. I haven't seen the details personally.
In the mean time I am in the process of getting another Academic Equivalence evaluation.
I am planning to prepare another detailed document explaining all the details in the transcripts and how to intrepret the transcript.

Thanks for that detailed description from immlaw. I am sure it will help a lot of people. I have responded to education Rfe 3yr+1.5yr dipl. and am waiting for the adjudication.

REF Major Field of Education

Got REF on Education Evaluation:
Evaluation is necessary to determine the level and major field of education attainment,as described in the supporting documents, in terms of equivalent education in the US.
Consider formal education only, not practical experience.


My Attorney mentioned in LC By mistake in place of "or" mentioned "and"
College Degree Required: M.S
Major Field of Study : Comp.Science and related courses.


Below I have the US Equivalent summary done by World Education Services Inc, NY.
Master's in Mathemetics, Master's in Education, one year of post-secondary study and trainng at computer training Institute.

Is any problem in my Major field of study which is mentioned above
(Compu.Science and related courses) in labour based on my evaluation?
