I applied for EB1 Manager/Executive Green Card in 2008. In March-2009, I got RFE. UCICS is asking me to confirm at least one full-year of employment outside US (which is one of the conditions for this visa). In my case, I was on Indian company payroll (in manager/executive role) for 13 months, but during this time, I traveled to US on project works for 1.5 months. I think UCISC is concerned that I was in India only for 11.5 months (which is less than a year). Do you think it is a cause of concern? If yes, how can it be mitigated?
Also, I actually worked as a non-paid employee of this company (as a co-founder, helping in setting up this new company) before my payroll/contract was signed/put into action. However, I did not furnish this detail when I filed my green card last year (since I did not think it was important). But now it seems that it might be relevant/critical. Please comment, and suggest how to present this to UCISC.
