RFE on companys ability to pay

any help in replying this rfe for I-140 is appreciated.

1. Company's financials- income tax stmnt, Balance sheet etc. profit stmnt- if company is public you can get it all of the net.
2. Years of existense
3. No of employees

the company is small and making profit but profit is not much

I also work with a small company (15-20 employees). We had a RFE for the company's ability to pay during the I-140.

My lawyer provided them,

Last three years Balance Sheet and Profit statement.
All the employees/staff salary details
My W2 for all the years with this company
My paystub for last three (may be six) months
and A very strong letter stating, how the officer was wrong in interpreting about my company's ability to pay.

No I don't remember (I think the RFE response copy I got from my lawyer had all those information blacked out). But, I remember my lawyer mentioning in the letter that. A company's ability to pay does not come from how much profit the company made. Companies normally make lots of adjustments (especially small companies) to show low profit so that they have to pay less tax.

We showed them the details about how the company paid to its employees/staff in the past.

My I-140 got approved long ago (May, 2002), I was actually worried after looking at the RFE response from my lawyer. It was too strong. I am now in the I-485 stage for more than one year.

Hi What_is_name...

I too got Same RFE recently....
I got a question for you....Whrn you answered your RFE did you submitted yopur w2. How it going to impact if w2 amount is less than Salary mentioned in labor.

Yes, we had submitted my W2. Salary in my W2 was not less than my LC salary, so I can not answer your question about the salary difference. Sorry ...
