RFE on BC. Please advice!

Hi Guys,

I was issued a RFE Birth Certificate for me & my wife & I had the submited the BC issued from the Munciple authorities, at the time of filing.

The RFE says "that documentation submited as evidence of birth & percentage were executed so long after the fact they are attesting to that they are considered hearsay evidences.Therefore you must submit other documentary evidence"

Please advice, as what documents best supports the RFE.

Sorry!; I didn't update my profile.

Yes, it did changed, consistant with others & received 2 e-mails for each approval (EAD,AP) & I think those approvals might have trigered the I485 RFE.

These are the documents I have submitted for the same rfe generated for my wife.

1) Affidavits from her Father and Mother
2) School Bonafide certificate with DOB and father's name
3) 10th Marks certificate with DOB and father's name
4) Inter marks certificates with DOB and father's name
5) Conduct Certificate with DOB and father's name
6) Passport with father's and mother's name

If her parents have Medical insuerance with all the family members names, try to put that.

If you are from india and have ration card with all the family members names, you can get it translated,notarized and put that to.

Affidavits from parents (Father & Mother) are treated as 1 or 2 affidavits by USCIS?

Does geting an affidavit from an Aunt (Father's sister) is Valid enough?
Please advice.

You should submit two different affidavits from parents(one from mother and one from father).

Getting a 3rd affidavit from Aunt definitely helps.

3 Affidavits; 2 from ur parents and 1 from any relative will be enough. BUt if you can provide any other docs i.e. 10th CBSE dob cert or anyother item listed by octFiler will be helpful.

Any relative will work.

Just one other ..At the bottom, The RFE requets for details on how the affaint acquired knowledge of the event (birth).

How detail the explaination should be.. & will these answers be validated by USCIS for any reason?

I am expecting the same RFE for me. I have one question for you - what is the "Date of Registration" of birth on the Birth Certificate (note - I am not talking about "Date of Issue" of the Birth Certificate). Do you have the "Date of Registration of Birth" information on your birth certificate and if so, what is that date?

The date of registration is the date and time when the hospital writes the record of the birth in their file or document. It might be within couple of hours of the birth. In my case, Desi Babu did not write the date of registration and hence I got Birth RFE. I will be submitting the reply soon. My documents are almost similar as listed in previous replies. Hopefully, I will get my translated & certified ration card soon to submit the reply.

Date of Registration

From all the information I am gathering, I think people get RFEs for Birth Certificates if all of the following is true:

1. Birth certificate is issued "Date of Issue" recently
2. The "Date of Registration of Birth" is either not present at all OR is very recent too

Is my conclusion correct? I think, if we can determine this, we can help prepare other people in similar future RFEs. Can all the people with birth certificate RFEs explain their situation with respect to the above two points?

In my opinion, you are 100% correct. I have recent "Date of issue" and No registration date on my birth certificate.

Hi Guys,

The "date of registration" does exists on my BC & was dated the time it was issued (during I485 filing time). I don't have an Issue date.

To what I have seen & Observed from other posts, If the Date of Registration on the BC is NOT within 1 year from your Birth date, then it would certainly call for an RFE.

Folks,

My date of birth is 14 June.
My birth certificate states 14 Sept, instead of 14 June. All other docs like School/college leaving certificates, passport say 14 June.
The local munciple office people say they cannot change anything in the certificate.
What are my options now?
Please help.

firstly make this q as a separtae thread for more responses.
2nd ur situation is ugly because providing a BC with wrong date is just WRONG & not going to help u in any way.

You'll have to provide 3-4 notarized affidavits about ur birth from parents/relatives in addition to 1 of these items.

Can you get a letter from municipal office that they are aware of the problem but due to laws/regulations they can't change the date?? If yes then provide this letter affidavits & all other certs with right dates.

If local office can't give you that letter then ask them to look for a record on june 14th for ur name, obviously they won't find it as per them u were born on Sept 14; so they MUST give you "Record not found" (RUF) certificate(get transalation in ENglish if notin english).

with this RUF certificate u'll be in safe situation and when u file 485 don't include ur BC just send affidavits/other docs & RUF.

Ok i think that shud do it. wait for other ppl opinion and consult ur lawyer.

The municiple people say they cannot give the "record not found" certificate as they say they have to "not find" anything for 1974/75/76.
