I have received the RFE as stated below for spouse and myself

1) Birth Certificate - they want it issued by civil authority and parent's
names on it;

2) Federal Income Tax return - For last two years including W-2/1099's;

3) Marriage Certificate - from civil authority

I have issues with Birth Certificate.

For spouse: we have Birth Certificate in local language, birth certificate issued by school and school leaving.

For myself: we have Birth Certificate in local language, domicile certificate, school leaving, college leaving, and SSC passing certificate.

What should we do? Please Please advise.

Thanks,

hdixit

Birth certificate issued by school may not be considered as birth certificate. It can be used as secondary proof of birth, but not as a primary birth certificate. You need to obtain birth certificate from your local area where spouse was born (city corporation office or rural area authority). If they cannot issue birth certificate get a non-availability certificate from them. And then get two affidavits from your parents/relatives.

You will get some info here:

I hope your birth certificate is in some other language (not in english)..

Let us say .. your birth certificate is in Hindi.

do the following:

1. Find a person who knows Hindi and English

2. Ask him to translate the letter and ask him to give INS a letter saying he knows HIndi and English. And whatever he translated is correct.

3. Get his/her (translater)'s driving license photo copy.

4. On top of this.. get a affidavit from local bank or your lawyer saying.. this person knows hindi and english and he is the one translated this letter..

thats it .. you all set..

all the best

My lawyer is suggesting using a tranlator service provided by Trust Forte... they charge approximately $150 for one document. I think it is rediculous.

Try ABC translation sevices LLC.
They charge $90 for translation +$2 for notarizing.
They did my job superbly for my bc (rfe 1)
1-800-284-2468 and ask for Jodie Castro.

Thanks Pralay.

I do have them but they are not in English

You don't need cartified yellow page translator. Anyone who knows both the local language and English and read/write both languages can translate for you. You just need to notorize the translated copy after that.

You can get affidavits from Parents and a Relative in English saying that this affidavits are for your BC and specify that original BC issued is i Local language. With this you dont have to get an NA certificate..

I heard some one did this and got it approved..

Check with your Lawyers.
