RFE - Notice date 06 Nov 2002 (for maintenance of status)?

RFE sent: 23 July 2004

I got my RFE last week. It is asking to submit the evidence for initial lawful admission and continued maintenance of status. have any one got the same RFE?

My questions are:

1. I got my RFE in my attoney's office and they forwarded it to me. Is it okay if I send the documents directly to INS? They have some problem in doing this since I changed my company (the attoney works for the previous company).

2. For initial admission is the copy of the passport and the initial I-797 enough? In the passport the departure & arrival date is stamped. The only problem is the arrival stamp is not clear. Is there any way to get the initial I-94 arrival/ departure record - I have only the latest with me.

3. For continued maintence of status I have all my approved I-797 notices, the current I-94 & the copy of my passport. Is this enough?

4. Do we need to write a cover letter while sending the RFE?

This needs some covering letter which describes you arrival dates and list of the companies you worked with from date and to dates. Such letter is usually sent along with H1 application as enclosure. I-797 can be used as supporting documents.

If you have original RFE notice you can answer with that

SRM I don't know what an LUD is. But my online status message changed after they send the RFE.

Does any of you guys send an RFE by yourself to INS?? ( Not through attorney )
 
Initial entrance

Hi Mohan,

I thought they only ask to prove status since ur last entry/visa into the US. why are they asking for evidence of inital entrace and maintenance of status since then?
can u please post details of ur entries and visa and all that. are you Employment-based?

Any of you guys Send the RFE by yourself ? (Not using your attorney)

Hello Spartacus,
I came to this country in H1B and was on H1 till I got my EAD in 2003. According to the letter from INS , they need the initial entry and continuous valid stay in US.


I am trying not to Use my previous company's lawyer since they may notify my previous company.

I had the same RFE

Mohan,
I had same RFE. You do need to write a covering letter with the details( valid and expire dates and src #s) of all your visa/EADs. My attroney had asked me to send him a detailed letter like this which he modified a little bit.

I had just sent them copies of all my H1 approvals and 1-94 and copies of my EADs. Place them in the same order as you have them stated in the letter.
