RFE not received ,Please help

Hi Gurus,

My RFE was dated 23rd Nov and the attorney still claims he hasnt got it. He changed address and hasnt informed INS about the change for the old cases. He insists that ll the mails get forwarded to him in a timely manner . Unfortunately i have to wait for 30 days to request a duplicate copy. In the meanwhile i am planning on getting organized with all possible docs. I am worried if they ask for a birth affadavit as my parents are here visiting me in the US . I have submitted the orginal copy of the original BC at the time of filing applciation. I also have my SSC certificate and primary school Transfer certificate that has my date of birth on it. If they ask for affadavits from my parents what can i do ? They are here with me in the US. Your help is greatly apprciated .

RFE's will not be forwarded to the new addresses. If the RFE is not delivered to the original address for any reason, it will be sent back to INS and the online status will reflect that after some time.
You will have to call INS again updating them with the new address and request them to send the RFE to the new address.
I was stuck in this situation for about 3 1/2 months to get my I-140 RFE.
All this trouble points to only 1 reason - The 1-800 customer service cannot access our personal records and they keep saying that everything will be fine. But in reality, we all know that does not work.
Ask your lawyer to be pro-active and keep sending letters to INS to change the address and send the RFE to the new address.

Donot think too much about it. But, after 1 month, you definitely have to have your attorney send them a letter asking for a duplicate copy and send appropriate form to change your address on your applications. As for your affidavit, if your parents are here, I wonder why your parents would not be able to provide an affidavit. in USA.

GcWaiter, even I had to wait for 3.5 months for my I485 RFE, and my application ended up being transferred to local office.

Firstly thanks for your valuable advice. Since u guys have had experince with this could u let me know if u guys did anything on your part to keep things moveing. Eventually did the RFE land in your hands or the attorney's . My attorney is getting on the defensive when i tell him its because he changed his address. I dont want to piss him off too much at this time and trying some diplomacy . Its so frustrating to first worry about what INS does with your file and when they do work on it its now in an unknown land. Please guys, please pot what u guys ended up doing . Thanks once again

I am quite concerned about mine as I am not sure how will I be able to produce paystubs from the same employer as I am not working for the same employer... anyways lets see what happens........

As I told you, I never got my RFE inspite of Faxes and letetrs being sent my attorneys office. I pursued them to do what they did. When they sent Fax, the reply was, they cannot respond to FAx request for RFEs. They did send request letters twice.

You donot call the 1800, becos you cannot update attorneys office address and attorney cannot call for 1 month once you call 1800. So, follow up with attorneys office. But, donot take stress. You should make sure attorneys office send letters to USCIS, so USCIS knows it is not an abandoned case. Besides calling USCIS, have them send a letter.

My case was eventually transferred to local office, without RFE being received.

Thanks for the input. your advice just came in time. I was all frustrated and about to pursue the case myself. I will bug the attorney and get him moving on this. Thanks once again for your input.
