RFE : no receipt, no LUD

Hi,

I got a RFE for our I-485 (more precisely, our I-864 and no idea what was wrong with our first one). We sent back and it has been received by USCIS the 19 July 2007 (USPS confirmation signature). Since then, no LUD, no RD. I called USCIS and they keep saying "allow us 60 days to open the mail". Do you think we should resend the RFE package?

If you have an application/receipt number go to https://egov.uscis.gov/cris/jsps/index.jsp and click on create/edit customer portfolio account.

Follow the directions to create the account. When done log in and click on one of the options to add a case. You can also sign up for email updates.

If you don't want to create an account then go to www.uscis.gov and to the right of the screen enter your application/receipt number where it says "Check Case Status"

It only took them a week to open mine and resume the AOS process... but it has been almost 1 month for you guys. I would not re-send the RFE package (unless you have a copy of the RFE letter, they need to scan the bar code in it).

Best thing you can go is make an infopass: http://infopass.uscis.gov/index.php

And bring whatever the RFE asked for to your local District Office. Inquire about it. If they still see it as RFE then give the requested info to them.

I notice that you are a J1 visa holder. Were you subject to the two year foreign residence requirement?
 
No, I wasn't. Also, my J1 status expired the 1st June 2007, but I don't think it should matter since I filed the AOS during my grace period (30 days).
