RFE never received even after more than 1 1/2 months!

Hi all,

I am really upset as neither me nor my lawyer received RFE from INS which have been issued on Nov.27 2001 as per INS AVM. My lawyer has already sent a fax inquiry but no response even after 2 weeks. Talked to IIO sometime back but he suggested to send fax inquiry but this does not seem to work.
Has anyone faced similar situation? Any suggestions please. I am concerned as it is almost going to be 2 months since they issued RFE and I even don\'t know what it is about.

INS quirks

There have been cases where INS has sent RFE as per AVM, which the applicant never received. But presto, the application gets approved some time later.

Maybe you are one of those lucky ones.....
 
Similar thing happened to me.

What I did was that I called CSC twice. Finally one officer was kind enough to promise to have my files checked. A few days later, I got a photo copy of RFE from INS directly. Remember, they normally go to the attorneys.

My attorney said they sent fax inquiry, but they also said they never received anything.

I actually posted the information a couple of months ago. My conclusion at that time was that I had to take the matter into my own hand. Sometimes the people who are paid by us don\'t do their job..., at least not well enough.

Can you please explain in details about the steps taken by you. Do the IIO help in these type of cases? Did you send any fax inquiries yourself?

I had very bad experience with fax inquiries as I received my FP notice with much efforts from my lawyer pushing through AILA liason after tens of futile fax inquiries going into INS blackhole.

Another interesting fact is that when I called IIO about a month ago, She said that the RFE has been withdrawn and I won\'t be receiving any mail regarding this. So I took it easy and felt relieved as I was kind of already struggling with INS to get my FP notice even after 9-10 months of filing I-485. But recently I was lucky enough to talk to another IIO and he catagorically stated that the RFE had been issued on Nov. 27 and he could not locate any information on his system indicating that the RFE has been withdrawn. So again I am in same hopeless situation.

So I am kind of hoping that the things will straighten out by themselves and wondering whether it\'s just the patience which I need besides prayers to deal with INS.

Here is what I did.

I did not send fax inquiry myself.

I called the 1st time when 2 weeks had passed. I told the officer that the AVM instruction asked to call if RFE was not received after 14 days. The officer simply asked me to wait for another week. I got a little disappointed at her answer and said something like "I don\'t think I can trust the system now". I don\'t think it was a good idea for me to say that. Fortunately, she did not take it personally and suggested that I should have my attorney send a fax inquiry.

I called the 2nd time about 3 or 4 weeks after the issue date. I talked to a nice lady, told her that the situation was driving me crazy and she patiently listened to me. She verified my home address and the attorney\'s address. She even let me put her on hold so that I could find out the correct address of the attorney. Then she promised to check my file and have the RFE issued. I then received a mail from CSC a few days later.

When I received at my HOME ADDRESS the PHOTO COPY of the RFE directly from INS, I knew it was because of her help. Apparently, the copy that I received was a photo copy over another photo copy.

The attorney said that never received anything. Normally, RFE\'s go to the attorneys.

I know exactly how you feel now. As a matter of fact, I am not feeling much better then I was when I was waiting for my copies.

One thing I can tell you, we do need patience, a lot of it.
