RFE : Need suggestions

Here is my situation :
1) Comany-X Visa is valid till 01 May 2001 and applied for another H1 thru
Company-Y and H1 Visa is valid from 9/1999 thru 04/2002.
2) Went out of country on 11/01/1999 and came back on Company-X Visa on
03/01/2000 and I-94 was given till 01 May 2001. I worked for Company-Y.
I had Company-Y H1 with valid I-94.
3) Since my I-94 is only till 01 may 2001 i sent my passport for Stamping
with Company-Y Visa while i was in USA and requested for I-94, USCIS
stamped my Passport which is valid from 01/ May 2001 thru 04/2002 and
they told me i can use the I-94 which i have attached with my Company-Y
H1.
4) After 04/2002 Got another H1 with Company-Y which is valid from 04/2002
thru 2004 and the Company-Y sponsored for my I-485.
5) Last i went out of country on AP and came back and have I-94 with AP.

Now i got an RFE with Legal Status issue and Proof of Passport copy. I didn't see the RFE but i just got message from my attorney RFE is about Legal status and proof of passport copy.

Am i in trouble? If so how can i get out of this problem?
 
I am in similar situation and here are my details -

Came US on 7/98 with Company X
On bench with Company X (never got pay for them)
Join Company Y (start date is 10/98)
Company Y H1 Visa approved on 10/98 (I don't have copy of I-129 form to know the start date they put on that form)
I never work for Company X between 7/98 till 10/98 nor received any pay during that period (not sure how Company Y get H1B approval at that time)

My I140 and 485 is still in process. Am I in trouble? USCIS will consider I was out of status between 7/98 to 10/98 (I was on valid H1B visa during this period on Company X H1 visa)?

I have not show Company X in my resume or also not mentioned in Labor Certification. First job in Labor Certification approval is 10/98 with Comapny Y. No reference of Company X in any paper work other than I have to send copy of I-797 from day one for I140/I485 and passport do have reference of Comapny X. Not sure how this will impact my I140 or I485 petition.
