Earning statement means W2 or paystubs? In my RFE, it is mentioned as three year earnings statements and I feel we have to submit W2s for the past three years but my attorney's office say paystubs for three years which sounds ridiculous. Does anyone have any idea / input? Thanks.

Paystubs are the earning statements. Usually all past W2 with current year's paystubs are asked.. but this looks little different. Probably they want to find any 'gap'?

Just my 2 cents..

I don't think they care about gaps etc- gaps don't matter as long as you are in status.
The earning stmnt should mean last 2 years (or 3) years W-2s and recent (last 2 months) pay stubs.

Earning Statements mean Paystubs

W-2 are not earning statement but summary of earning for tax purposes and called "W2".

Why do they want for 3 years ? They may demand anything they wish. (no future employment concept here)

Earnings statements means pay stubs. So they are asking you for last 3 yrs pay stubs. If you have continuous pay stubs for the last 36 months with proper pay, then go ahead and send them. Otherwise, write that you don't have a copy of all the old pay stubs and just submit W2's for last 2 yrs and last 1 yr pay stubs.
