RFE issued

My lawyer received the RFE letter today. It asks for the
- Employment letter
- W2s for the last 3 years
WAC-01-293-xxxxx

It was only a couple of days when my lawyer had told me that the employment letter is valid only for 12 months and all the cases which are pending for more than 12 months will require to resubmit their employment letters again. So, all WAC 01s and others, you may be asked for the employment letter soon.

My current salary is about 10% less than my Labor certification salary as I changed job couple of months back. Is it neccessary to mention the salary in the employment letter ? Please suggest guys. Also, can one reply to the RFE by himself instead of asking the lawyer to do so ?

future salary vs current salary

Employment letter should state that the company is willing to pay you that much (as indicated in the labor certificate), SHOULD YOU BE granted the green card in the future. The salary should be the "promised" salary, not necessarily the current salary.

My HR agrees to do so, since my current salary is also less than the LC salary.

This info is from my attorney. I was quite surprised when I first heard about it.

When you refer to the future salary, which salary are you referring to ? Salary when you GC is approved ? I suppose you are already working the company and they have set your salary. Have they agreed to give you LC salary once your GC is approved ?

My lawyer is recommending not to mention the salary as the RFE letter from INS does not specifically ask for it.

I think its an invitation for INS to issue one more RFE asking for salary. That is so because AC21 specifies that the changed job should be similar in nature and salary.
