I called VSC two minutes ago and the IIO told me that I got RFE on 12/14 but it is not mailed out yet due to clerical department backlog. I asked how much time I have to respond. She said 90 days. Did not tell me what the RFE is for. Does anybody have any idea how big the backlog is ? Meaning how many days they are taking to mail after an RFE is issued.

Nope, I did not ask her that. She just said, a request was issued for additional info on 12/14 and it has not been mailed out.

I still do not know what the RFE is about. Lawyer is supposed to get the notice (thats what the IIO told me). And my 485 ND is Sep 13,99. I did my FP sometime during June/July 2000 timeframe. Forgot the exact date.

Hi Kiran:

I am going thru a similar process. My first RFE was received on July 10. They received the reply on Aug 4. Typical RFE1-Emp letter, salary drawn etc. Nothing happened for 3-months. I called an IIO on Nov 27. She said they issued another RFE but would not say about what. It was mailed on Dec 18. It was for evidence that shows I was in this country legally. They could not establish my legal status in this country. So I sent all the visa copies, my PhD degree, my I-20ID, copy of the EAD, H1-b approval etc. This, hopefully, should be the end of it.

My deets BTW are: EB1-1 (extraordinary ability), I-140 Approved Dec 98, I-485 ND Mar 1999, FP Mar 2000, RFE1 Jul 10, RFE2 Dec 18.

BTW: as per my lawyer, there are many many RFEs being issued to Indians and Russians due to apparent document fraud prevalent in the cased of EB1-1, EB1-2, and EB2 (NIW) as you do not need LC and employer sponsorship in EB1-1 and EB2(NIW).
