RFE Issued... Not Recd. yet... Got laid off in between... Any Help is appreciated!

Mine is an interesting Case!

I was with Company A(Lawyer A), that applied for my I-485 more than 2 years ago. Then Company B acquired Company A. I have been following up with Lawyer B(of Company B) all these times.

I did my Second FP in February 2004. THe online status never reflected that!!

About 10 days ago, I got laid off from Company B. And, today I checked the online status after seeing the JIT move. The online status for my I-485 says, RFE issued..

Although, I am glad that, the case moved a bit after 26months...

That Darn Thing RFE, I had been waiting for RFE all these two years and they issued it now and I don't have a job.

Now I am not even sure where the RFE will go to... (Lawyer A) or (Lawyer B) or what!!

Is there any way for me to know who will receive the RFE?
Is there a way to obtain a copy of RFE from the BCIS### directly?
Should I hire a Lawyer of my own?

RFE went probably to lawyer A.

Since you did the FP and RFE usually means there's approval coming, call up both lawyers, A and B and explain the situation. Retain the one who got the RFE and hope he's good.
You should have a job at the time of RFE if it is for EVL, but since you've been laid off so recently, you might get to use the most recent paystub. The main thing is - listen to the guy and don't volunteer any info to INS. Pray that you don't get the interview.

I know of someone who was in a similer situation and got approval. After talking to your lawyer,send the eval if asked , last 2-3 months paystub etc.

Hopefully INS will not dig anymore beyound RFE and you will get your approval.

If this doesn't seem right or your lawyer says that you have to have a job then you contact some deshi company and work it out with them. It will cost you some money but you will get your GC.

The online status says "On March 23, 2004, we mailed a notice requesting additional evidence or information in this case. "

That means, this notice could be still in transit. I will try calling Lawyer A first and see whether I could intercept that notice.

Will post the details later.

Update

Yesterday, I got another FP notice from BCIS. This is the 3rd One. I got my second one done only a month ago:confused:!!!! Dated March 23rd.

Most likely the message I saw in the online status refers to this FP notice. But, I don't understand why they should make the message so generic and ambiguous. Message is in quotes below.

"On March 23, 2004, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice, please call the National Customer Service Center at (800) 375-5283."

Now, I am not sure, whether 3rd FP is all they sent me or there is an RFE also sent to the Lawyer.

I called the Lawyer few days ago, he said that he would send me the electronic version of the papers he receives. So I hope to contact him early next week.

Whether the papers go to Lawyer A OR Lawyer B is totally dependent on filing of form G28 (if I am not mistaken about the form name), which signifies change of lawyer. Once the lawyer information is changed, (Usually this happens the moment Lawyer B gets your case, he/she will file for change in representation for you, since Lawyer A can no longer represent you). I would put my money on Lawyer B as compared to Lawyer A.

Now to answer your RFE, if it is EVL, that is a relatively simple thing,
1. Get another job, or
2. Illegally, some people do speak with a few Companies out there, that do a lot of this, and get an EVL from them. Generate a paystub to submit with the RFE reply, and then spend the time looking for another job that you can change too.

It is very unfair to make you wait for such a long time and then POW get you one on the nose.

Why don't you pretend you did not receive the letter and call the service center to find out what they have sent to you? I don't know if this is a good idea but you can think about it.
