RFE issued for 04/2002- seems lost somewhere

Hi friends,

I am in Apr/2002 (LIN-02-177) group. I see that an RFE has been issued for me (primary) on Jan/21 but seems like it is lost somewhere. It's more than 14 days and my lawyer hasn't received it yet.

My lawyer's assistant told me that we have to wait 4 weeks (not 14 days) to request for re-issue of the RFE. But the online status still shows: " if 14 days have passed and you have not received the notice, please call.."

- Has anyone hard of this "4-weeks" thing? Or is my lawyer's office just giving me some kind of explanation?
- Can I verify that statement with BCIS myself? Only question is RFE goes to lawyer and I am not sure if applicant can request a copy of that as well.

I was in the same boat where my RFE got lost somewhere in the mail probably because my lawyer had changed his office and hadn't informed USCIS properly. Anyway, after trying to have the lawyer call the USCIS quite a few times (he probably did eventually), I called the customer's service myself and gave them the lawyer's address. USCIS reissued the RFE within a week. I would say go ahead and call them yourself if 2 weeks have passed, but don't let the lawyer's office know so that they try to do the same when they think the time is due.

See above. You are correct that the RFE goes to lawyer and I don't think they will send you a copy. It's my opinion. Others may think/know otherwise.

RFE issued for 04/2002- seems lost- Now APPROVED!!

Well, seems like I am another lucky April/02 guy- my GC story is finally over (and I must feel happy that the end-to-end GC processing took approx 2.5 years, even in this bad time).

The RFE story:
The RFE was actually lost and BCIS didn't re-issue it until 30 day window has passed. Yes, it is now 30 days!

RFE (finally) received: 2/23, for Employment verification only.
RFE replied: 3/1
485 Approved: 3/17, for both me and my spouse.

Here are some important facts about my case:
1) Special registration: I am a special registrant. No special RFE for that.

2) Tax document: I haven't submitted Tax documents when I applied 485 since that time it was not required to submit. I was 99% sure that I would get an RFE for that, but No RFE for that! (However, I can assume why.)

3) LC-sub: My case was an LC-Substitute, which saved me from another round of delay since my state has the worst LC processing time. No special RFE for that (at 140 or 485 stage).

This site is really great, and it gave me the mental strength to overcome this difficult time. My sympathy to those who are before 4/2002 RD date but are still waiting. Your day will come soon!
