Hi Guys,

If I want to change attorney after RFE is issued before replied to RFE. Is INS going to say any thing about change.
What kind of problems would I get from INS.

For some reason my souse is working from home for last 10 months. Attorney is asking for drivers license(my spouse changed drivers licence to state where we live), credit card bills, meidcal bills, isurance etc to prove that spouse is living there. Is it safe to change address now.
Spouse is still keeping the old address for INS correspondence.

Please advise.

i have been following your threads concerning the address issue that you and your spouse have, and for which you have received an RFE.

it is reasonable to expect an RFE if the spouses are living apart, and some documentation should be submitted to prove whatever point you want to make to explain the situation, and at the same time to prove the validity of your marriage.

so, i have not understood your question: it seems your attorney is trying to address this situation. so where is the disagreement? is your attorney trying to prove something which you fear might be deterimental to your case? or you disagree with him on procedure?

i have also posted an opinion in another of your threads where you have said that you fear malicious actions on part of your lawyer.

you can always change lawyers, and file a new G-28, and have the new attorney send for your papers from the old one; but you must know why you want to do that, if your attorney is only trying to do his job. why do think he is being uncooperative?

my spouse is not staying at the address gave to INS. Now atttorney is asking for solid proof that spouse is staying at the address given to INS. spouse doesn't have any kind of proof that of staying there. Attorney wants some thing like drivers license, bills, etc. Attroneys suspects that spouse is not staying there hence he wants to withdraw the case. I don't know what to do. Looks likd all my dreams are dried up.

so, can I change the address now and reply to rfe. or change the attorney. Don't know what to do.

Any suggestions.

I don't get it, and maybe that's what INS wants to verify. Why did your spouse give a wrong address, or if moved, has not given a change of address? It is better to be upfront with INS oops BCIS. It seems that your lawyer has a point and is uncomfortable providing wrong information. Does your lawyer know that he's not at that address?

Hope you are able to work things out.
