RFE in I-140, asking company's tax returns

Hi,

Got RFE, asking company's tax return for year 2001, my company had filled losses last year but no one is laid off till date. Had submitted 2000 tax returns which was profit. We expect to make profit this year. Mine is EB3
All who have simmilar experience and got approved please share experience.

I am in similar boat, I answer my query in June, but i hear nothing from INS yet. I dont know how things will trun out.
 
This requirement is critical

Submit additional evidence to establish that the employer had the Ability to pay (amount mentioned in Labour certification) as of March, 2001 the date filling and contuining to the person.

Does somebody know how to answer the same.

You need to send the corporate tax papers and all the financial information of your company. Ask you attorney and find out what he suggests. If you dont have any problem can you let me know what was the pays mentioned in the LCA and what is in in your W2?

Pay in W2 is about 20 % higher then what is mentioned in Labour.

Here are the details of the query.

1. Submit additional evidence to establish that the employer had the Ability to pay (amount mentioned in Labour certification) as of March, 2001 the date filling and contuining to the person.

2. Company's 2001 tax returns or audited financial statement. (We had filled loss for this year)

3. Beneficiary 2001 form W-2 wage and tax statements.

Question: What supporting documents should be provided for ability to pay?
