RFE I-140 addtional evidence regarding my MBA and Bcom

Hi All,

The Immigration Service is asking for additional evidence regarding my Master's Degree. They are asking for transcripts of the classes taken to achieve my Master's degree and my bachelor degree.

Attorney say's that he had already provided them with mark sheets from 1994 and 1995 from Nagarjuna University and an evaluation by FIS stating that my masters degree is equivalent to a US masters degree.

My Attorney not sure why the service is asking for this information as it is pretty clear that I have the equivalent of a US masters that is 3 years Bachelor of Commerce degree and 2 years Masters Degree (MBA), but what should give them the information they have requested, pleas help me if anybody come across the same experience.

The Exact words from USICS as foolows:

To establish that alien is professional holding an advance degree, you must submit:

An official academic record showing that the alien has a US advance degree (or foreign equivalent degree or An official academic record showing that the alien has a US baccalaureate degree ( or foreign equivalent degree ), and evidence in the form of letter from current or former employer(s) showing that the alien has at leas five years of progressive post-baccalaureate experience in the specify.

You have submitted copies of the Master of Business Administration and the Bachelor of Commerce degree. Please provide the transcripts for the classed taken to achieve these degree. They should list the starting date of the classes and amount of time in for each degree. This is necessary to determine the level and major field of educational attainment described in the supporting documents in terms of equivalent education in the United States.

In the event that the Service finds the degree not equivalent to Masters in the United States, Please provide evidence that the alien obtained the required five years progressive experience in the job offered before September 28, 2006. Evidence of experience must be in the form of letters from current or former employer giving the name address and title of the employer and description of the experience of the alien including specific dates of the employment and specific duties.


Please help me.

Any updates on your case . Mine is similar case as yours. I have BBA + DCA

and MBA from India and filed under EB2.

Don't sweat it. Many of the people reviewing these cases are not really qualified to do so. I had an RFE sent once with so many questions that I couldn't believe it. The English was so poorly written grammatically that I had to have three different people read the letter in order to understand what they wanted. We had already sent in many of the items they requested. So we just did it all again and everything was fine. So just do what they ask, and you should be okay.
Your transcripts are probably stuck between a paper clip, but they can't see it. So again, just do what they ask and you should be okay.
