Hi Guys,

Online message say's i was sent RFE, My dates are
RD - 04/11/02, ND - 04/27/02, LIN 0217150XXX, EB3/IND...

Just curious what type of RFE's ins is asking nowadays for
both primary and dependent applications ???

Thanks,
Novice

Dude,
Most postings i saw on RFE relate to Employment Letter for Primary Applicants and documents related to Marriage for Secondary (Spouse).

We got rfe for both primary applicant and spouse, and both are related to employment! But the one for spouse only
asked for the name, location of employer and start date of
employment.

Isn't that odd? Anyone has any clue why they asked for this kind of info. for spouse?

Me and my spouse both are on H1. While filing I-485 My lawyer just asked for my W2s not of my spouse.
So I anticiapte that my RFE should relate to employement and spouse's should be marriage related, if I receive any RFE.

In your case it is really odd.
But USCIS had asked just to establish your spouse's status nothing else. No W2s or salary slip.

What does your lawyer say?

Bakra,

We are also both on H1(my spouse got an EAD later but never use it, may the EAD be the reason to triggle the rfe?)
At first we planed to submit the copies of J2 working permission, H1 and EAD in case they need it later, but finally only provided the info. they asked for. Don't know it's a good decision or not.
By the way, we don't have lawyer.

just_watch,
I started writing and by the time I completed, you posted your reply to Bakra,

Was your spouse working independently before s/he filed 485 as a dependent?? RFE for her could be appropriate.

If your spouse started working after recieving EAD, then there might have been some wrong trigger, that they would like to verify.

In case your spouse has never worked, god knows what has triggered this RFE

I think it would be better to answer exactly what they have asked.
"name, location of employer and start date of employment."
Sometimes giving more information may trigger other RFE.

thanks for your input, Bakra and peace_of_mind.

yes, my spouse worked independently before he filed 485. But I heard many similar cases, none of them got such kind of rfe on spouse. Since INS spent some time to find my spouse applied an EAD and had worked before this EAD, maybe they themselves can also find he is keeping H1?!! Or maybe the officer was just thinking why not give the spouse a rfe to play since he has to wait anyway?!
