RFE Help please

I got a RFE today
they asked for
1. evidence for my faculty position---- can do
2. Elegibility for
waiver of labor certi ----------------- :confused: can do
patent will serve the national intrest---can do
must establish past record of speific prior acheivement to justify future
benifit to the national intrest
ability to serve national intrest to a substantially grater extent than the
majority of collegues
demonstrate degree of influence in field of employment

3. also copies of grant applications/awards for all research present and past
4. research cititations

Do I have to use the small envelope that I was sent?

If any body has any formats or plan of attack I will be very thankful

PLEASE HELP :( :(
 
I got an almost the same RFE

I got almost exactly the same RFE as yours. Who is your case officer? How do you plan to reply to the RFE? We may help each other. Thanks.

I have been contemplating using the immigration assiciations services, not decided yet. Prong 3 is a little trickey.

Additional evidence is requested to assist in evaluating eligibility for a national interest waiver pursuant to the tests established in matter of New York State Dept of Transportation,22 I&N Dec.215(Comm.1988).(please note:the evidence already submitted demonstrates that the proposed research employment has substantial intrinsic merit and will be national in scope).

If your university employers have conferred official professional recognition and/or standing on you relating to your employment, please submit official University documentation of same.

You must provide evidence, which addresses your eligibility under each of the following:

Eligibility for the requested waiver entails demonstrating that the national interest would be adversely affected if a labor certification were required. you must demonstrate that it would be contrary to the national interest to potencially deprive the prospective employer of your services by making available to U.S. workers the position you seek. If self employed, you must also establish the national interest would be adversely affected if a labor certification were required.

If you demonstrate that you hold a patent or are responsible for an innovation, then you must demonstrate that the specific innovation serves the national interest.

You must establish you have a past record specific prior achievement which justifies projections of future benefit to the national interest. you must establish,in some capacity ,your ability to serve the national interest to a substantially greater extent than the majority of your colleagues. you must demonstrate to some degree your influence on your field of employment as a whole.

Plesae submit copies of grant applications/award documents for all research in which you are currently participating or participated in previously. the complete documents are not requsted but please submit all cover pages and pages identifying the research participants and roles.

Please submit copies of any published articles by other researchers citing or otherwise recognizing your research and/or contributions.

How do you know the same officer? Is the case permanently attached to the same officer or they change if needed?

at the end of letter, you can see the officer's code
such as
NSC/dne EX461
 
Send it it in a big envelope with blue/yellow sheeton the TOP.
You don't have to use their envelope
You can just stick their envelope on top
 
SumeetBabu: did you have a lawyer? what did he tell you to do? My attorney told me we are not going to send neither copies of grants nor citations since it is not related to my case ( :confused: ), only supporting letters. what r u going to do with your RFE?

I dont have a lawyer, how ever for the RFE I will use professional help. I will be sending grants, citations and letters also. I will let you know more once I decide who is going to assist me.

Honestly as we solidly satisfy prong 3 which this RFE is about we should be fine. eb1doc has some very useful suggestions in other threads.

Will let you know as things progress.
