RFE Help needed .. gurus

Hi All,

Gurus .. if anyone has any info on this type of situation...please advice.

GC is a process based on luck... patience .. etc... (more than the skill that it is being issued for.) I have an example.

One of my friends was an Employee of company A for five years. Never on bench.. Went thru LC,I-140 etc.. without any problems.
Filed I-485 (RD -- Aug/2001 ). He has his EAD now.

Got laid off in July 2002. Since then looking for a job. No salary being paid and as a result no pay stubs.

Last week he got an RFE asking for employer letter and last six months paystubs. Employer says that he is willing to give Intention to Rehire letter to INS but no paystubs.

Is it OK or any problems foreseen.

Any info please...

Well he's well past the 6 months after RD. So all he needs is another job with the same/similar job descritption.

Is he working right now ? If so maybe he can request current employer to furnish an employment letter detailing his job description similar to the GC application (as mentioned in the LCA)

If he's not working , maybe he can look for a job, where they are ready to do this ? i think there's a period in which you can reply for the RFE (90 days ? not sure), anyway if he joins now, he might be able to get some paystubs to send to INS within the grace period to reply for RFE.

Uh..as for the letter by the company showing 'Intent to Rehire'..uh I'm not sure, but fromwhat I know that should work. As I understand GC is for a future employment not for your current job..but better consult a lawyer on that one.
