We applied for EAD on Sept 29, ND Oct 21 and got RFE last week.
Does anybody know what kind of RFE is given to spouse's EAD ?

Should I talk this with a lawyer since we didnt go through our current lawyer handling our 485.

Is there anybody who replied to this kind of RFE by themselves without going to a lawyer ?

Also, we did not take chicken pox vaccine at the time of filing 485. Can this RFE response be combined with this updated vaccine report or is it better to leave it for another RFE.

Thanks a lot

We got RFE for my wife's EAD. It was for the signature. Her signature was going a little outside the box.
RFE can be for anything. Wait until you get the letter which will specify the reason for RFE.
In our case, I asked my lawyer to respond to the RFE. I just did not wanted to miss anything.

RFE for spouse AP

I got RFE for my wife's AP last month. It was asking for marriage certificate. Lawyer responded immediately. He also said CSC sent RFE for almost every case for spouse's AP recently due to a procedure change.

got the rfe

It appears that they want the 140 for the application. I am confused. We enclosed the 485 receipt with the application. Also, they can tell all my applications based on my name. Cant they do a little checking and link the 140 for the 485 ? If I am not wrong, they will not even accept a 485 without the 140 (approved or pending).

Anyway any suggestions on how to reply to them without a lawyer ?

Thanks

just submit the documents required

Because of the concurrent filing of I-140 and 485, INS has to make sure that your I-140 is approved OR approvable before they can issue you AP and EAD. That is why they ask for 140. They don't bother to check it out from their system or make a judgement based on the date of the 485. Sign!

My husband got a RFE on his AP requesting 140. However, he is seeking derivative status. The letter from INS is so confusing and full of mistakes. Even though a copy of his I-485 is attached to his AP application, the letter still stated that: " A search of our service record fails to disclose that an I-485, application to adjust to Permanent Resident status, had been files on your behalf. Please submit evidence that I-140 has been approved, blah, blah."

Anyway, we just submit the I-140 required plus a marriage certificate. No news after two weeks of reply. Really frustrating and disappointing.

Status after RFE

INS process RFE letter very slow. We responded to RFE last month. But they didn't update the status until this week. INS mail room must be full of crap.
