RFE for prior driving violation citations

Hi,

I appeared for my interview today in st.louis center & passed the test. But in the interview I was asked if I have had any prior Driving Violations & I mentioned that I have had a few and didn't remember the date / years. I was asked to given a form ( RFE ) and said that decision on my case would be taken only on receipt of the information. I went by our city & county court, city halls and asked for my old violation lists and they are turning out with none. I know I had couple of tickets in outside state which also I am not sure how I would obtain. Also in the attached form they gave they have asked for all court deposition/arrest records. I went by our county/state court and asked for a clearance and our police department gave a document stating that there were no records found on my name. How do I proceed? Can I just attach these documents and send in or since I told them that I have a couple of driving tickets if I send in I will have to somehow obtain the list/depositions. Also my question is in such cases are these violations always considered arrests? I am not sure why they asked for arrest records when I stated that I don't have any arrest records. Please help.

Oh no, another "traffic tickets" thread.

The question is:

"Have you ever been arrested, cited or detained by any law enforcement officer (including USCIS or former INS and military officers) for any reason?"

My lawyer said "Include information on any moving violations you may have had". She said if I didn't I stood a chance of having something similar to what happened to you happen to me. So, I listed every ticket I have ever received (back to 1978). The recent ones are reasonably specific, the 30 year old ones are like:

Speeding ticket, Montreal Quebec, Late 1970s, paid the fine, Less than C$100.

You can ask for driving history certification from DMV for $20. Try in ur state motor vehicle department.

Did they give you a N652 results of the interview and the RFE form ? What does the N652 state ? Does the RFE form ask you to state violations or arrests ? Since you mentioned you have tickets, you should try and recollect traffic court info where you paid the tickets and try and get whatever you can from the courts. However if the RFE is just asking for arrests then you should attach the polic clearance also.

Yes, they did give me the N652 Results of the Interview stating that I have passed. And she gave me a RFE asking for 1) any or all arrests i've had and 2) the final cour dispositions for ALL traffic violations for which I have received citations.

I went by the local County/City police records office and asked for a background check.They gave me a sealed document statint that there were no records of any nature on my name/social.Will this suffice

4 out of 7 tickets I had are from within the city & I tracked down the ticket number and city where I had gotten them. I am going today to get the documents from the court office. Other three were from out of the state I have a call in to one of the city court office which I remembered the city name. The other one I don't have any information..I am at loss at this one as to what to do..

My suggestion is try to get your bank records and i am sure you can get some copies of the checks you have paid for those tickets and i am sure that will be a form of proof. My interview is also scheduled for 11/9 here in St.Louis and i also need proof of my previous paid tickets. I have called the city where i had my ticket since it has been a long time they don't have any record but are willing to give me certificate saying that i don't owe them any dues. You may try one of these methods.

FYI Others in this board are of the opinion that you don't need any proof of payments if it is below $ 500. 00. Did you try to point it to the Interviewer?
 
No,I did read about it when I was filling the application, but in the Interview, that point totally skipped out on me. I've tracked down all but one which I don't even remember.. I'm going to keep trying for that & if I can't track it I am going to go with all the ones I have and tell them that I could not track one down..

Pending Appeal Traffic Ticket

What should I do, if I am contesting a traffic ticket.
I mentioned it on my N-400, but have been waiting for a court date. If it is not resolved, I will have no record of it (on my driving record, as I have not been convicted of it yet) or of payment as I am contesting it...

I would keep all the documentations of all the tickets (including the one being contested ) just in case they ask. As long as they fall under the criteria of <500/non dui/non-arrest related, I don't think they should care. In my case I think what got the officer curious was that I mentioned that I don't remember how many tickets I had.. The instructions actually says "Note that unless a traffic incident was alcohol or drug related, you do not need to submit documentation for traffic fines and incidents that did not involve an actual arrest if the only penalty was a fine of less than $500 and/or points on your driver's license"

Generally you need to go direct to the clerk of the court in the district which issued the original ticket. Records for low-level traffic offenses are rarely kept by other agencies (e.g. DMV) beyond the statutory period.
