RFE for I-485 case

I checked the online status this morning. My husband's I-485 status is updated to "On May 14, 2003, we mailed a notice requesting additional evidence or information in this case. ..." Nothing has changed to my case status. (I am the beneficiary).

I don't this is a good thing or a bad thing.
The good thing is CSC has touched our case. For I always thought they might have lost our file or put our files in the storage room forever.
The bad thing is my husband got laid off 7 months after our I-485 had been pending. He switched his job and is using a new H1b now. I don't know whether CSC will deny our case because he is working for the university where he graduated instead of a corporation. He used to work for a telecom company when his I-140 got approved.

I am very nervouse now. It seems like we have to go through all the procedure that INS has set for the immigration applicants. It has been very easy for several of our friends. One of them sent the application one month before us. The case got approved May, 2002.

Where your husband is working is not as important as what he is doing and how much he is making.

Both of the above have to match what was filed in his labor application. The RFE is mostly going to be for paystubs, employment eval letter, etc.

I do hope things turn out well for you guys. Don't worry, still to hear of any rejections. If your lawyer can explain things out, it should be okay.

My husband is still working in the same field. He has been continuously working for the same person. When he was a Ph.D student, a famouse professor was his advisor. After my husband graduated, the professor hired my husband for his start-up company. But the company has no much money and is nearly dead now. My husband went back to school to work for that professor after he got laid off.
The problem is we don't know how to explain the job title. He applied EB1-outstanding researcher. We don't know what job title was put in the I-140 and I-485 application form. We asked the attorney's assistant to give us the hard copy. But she said, "No, we will give all your document back to you when your case is closed." I left message to her about this question. But she didn't return my call.
Just wait to see.
 
If you ask me, I think you should be okay. Outstanding researchers though trigger off RFE's (who doesn't these days) but they stand a better chance than normal of getting green cards thanks to their contribution to the society.

While the lawyer's paralegal is within their rights to deny you a copy of the I140. They HAVE to give you your original 485 receipt. Kick up a big fuss with the lawyer himself, and you will definitely get it. If you want to leave the country for any reason, you will need a copy of the 485 when you enter.

I called my lawyer several minutes ago to ask for a sample letter of EVL. He said we should wait to see what kind of evidence CSC needs. And he said the job changing was not a problem for my husband. I hope so.
He also mentioned that he has gotten a lot of RFE for his clients recently. So maybe it is the computer not the humanbeing who decides to sent the RFE. Or how can the only three I-485 officers send so many RFE recently. Maybe the three officer just send RFE, they don't spend any time for approving any cases. That's BAD!
