RFE for Experience

I have received a RFE asking more proof for the experience I have shown in my petition. I had been my current employer for about 18 months when my petition was filed. I have been asked to provide experience for 24 months. I have more than 36 months of total experience at time of filing. However, my previous employer may not be willing to provide necessary documents.

Can anyone please advise as to what other documents can be used? Also, does anyone have any idea as to how much time it may take after the RFE has been answered for the I 140 to get approved?

Request your previous employer thru email that you need the employment letter for immigration or government purpose. It is actually illegal for them to not provide you that. ofcourse they dont have to say how good you are etc. they only had to mention about start and end dates and your title. it is even better to mention the skills set details. Make your lawyer to send a formal notice to your previous employer for the employment letter.

if your employer is still not cooperating you can get it from other co-worker who has full knowledge about you employment with your previous employer. i read somewhere about this in some forum.

considering that you have got rfe you will not have enough time to sue your previous employer also. it is unlawful for an employer to not provide such employment letter for any reason. there should be some misunderstanding between you both. still your previous employer cannot do this legally. you can sue him for discrimination or retaliation.
 
If you have good relation with your previous employer, get employment letter from them. In addition to dates, skill set and duties (which matches exactly as mentioned on LC) should be mentioned.

If they do not provide, find out any collegue (project manager, if not group leader, or if not another team member) or person in your previous company, ask them to give a notarized letter for you.


The letter should mention how the person know you in the company and relation. It will be good if he worked with you for the whole duration. He also should mention that he knows you have the skills and performing the duties. Ask them to provide a contact number for INS, in case if they want to contact him (INS won't contact anyway).
