RFE for Date of Birth! Help!

RFE issued for Date of Birth mismatch in Passport and Birth certificate. what to do?..

I am not sure, if the dates are really different...or INS making a mistake...

Can U calrify, if the dates are really different in both documents...???
 
are the birth dates different in passport and birth certificate..

or INS is confused with the date formats dd/mm/yy (maybe your passport is dd/mm/yy and birth cert is mm/dd/yy)

No my DOB dates are really different in passport and in Birth Certificate. Passport indicates dob as 06/73(mm/yy) where as the one in Birth Certificate carries 09/72.

I had submitted 2 affidavites for name clarification(since at time of birth I was not named yet) that has 09/72 as DOB(same as Birth certificate).

Just 'correct' one of them to make them match. It is more difficult to modify passport. Thus it will be relatively easier to correct birth affidavit.

I think this is your problem. You should check data consistency before you file it. learn some lessons and move on.

talk to lawyer, i think this is a serious issue?
you cant say one dob is wrong and other one is right.
consult 2 lawyers, i guess.

Guys. The date of birth in my school certificate was entered differently than the Birth Certificate. In india, date of birth in school certificate is considered as official document of proof in all dealings. In my case unfortunately this got gradually carried over to the passport as well. Now here i am standing in a situation where my Birthcertificate carries a different dateofbirth other than that in the passport. Also I produced 2 affidavits along with the birthcertifiacte for name clarification(since I was not named when my birth was registered) that carries the same dateofbirth as in the birthcertificate.

so to consolidate

1) Birthcertificate has dateofbirth xx/yy/zz.
2) 2 affidavits submitted(name clarification)carries dob as xx/yy/zz
3) passport carries mm/dd/yy(different from 1 & 2).

2 birthdates

You cannot have two birth dates under any circumstances... So one of them has to be stated wrong. As somebody suggested earlier, it would be easier to say that the submitted BC is wrong(even though it is actually the correct one)... get a new one with the date on the passport and move on. I know easier said than done. Correcting mistakes are much difficult than making them. Also, talk to your attorney. He/she should have caught this earlier and advised you appropriately if they did their job - unless you filed yourself. What are they? - mere admin assistance to type info on the form and drop it in the mail. I can get that help from anybody at $10/hr.
