RFE for Birth Certificate

Hi all,
I received an RFE for birth certificate. My birth certificate does not have my name on it and was issued by the hospital. What other documents can I sumbit and does anybody know the recommended format .

Here is the affidavit format from immihelp.com

You need two affidavits from your parents or your relatives.
Since the certificate you submitted was issued by the hospital I
think you need to obtain Non-Availability certificate from local
authority(Local authority depends on your place of birth).
Non-Availability is required in the case if your brith is not
registered(I am assuming this is the case otherwise you would
have submitted original itself with the applciation).

Letter Format:

One possible format of the affidavit may be something like following:

I, (name of relative), solemnly state and affirm as hereunder:
(1) I presently reside at ___________________________________.
(2) I am a citizen of _______________________________.
(3) I was born on ___________________ at________________.
(4) I am the (state relationship to the person whose birth is being verified)
(5) I personally know that (name of person) was born on ____________ at _________.
(6) A request has been made with the proper authorities for (name of person)'s birth certificate but the same is unavailable.

I hereby affirm under the penalty of perjury pursuant to the laws of the United States of America (28 U.S.C. Section 1746) that the foregoing is true and correct.

This affidavit was executed on (date) at (Place).

Non Availability Cert.

I guess that, since you have given BC from Hospital, BCIS might be asking for Non Availability of BC for local authority.
 
Prang your case is almost same as mine

I received Employment RFE and BC non-availablity RFE on 2/20. I had submitted 2 affidavits and no BC. I had my BC but it did not have my name on it. My attorney thought that affidavits were enough. but it were not.

I responded to RFE on 3/13 with original registerd BC (without my name), 2 affidavits, and a statement from local municipal corporation that name cannot be added to BC after certain age.

I don't know if this is good enough or not. I'm still waiting, and frankly it does not look good. I feel that if they were to approve the case they would have done it by now.
 
Heard recently that you can get a birth certificate from the local Indian Consulate and submit it as response to the birth certificate RFE. Anyone with any experience on this?

Dont know if it will be called 'birth certificate' then.

It is useless, if you want you cAn have it but BCIS would not accept. Even I thought the same, and obtaoned one from chicago consulate. After seeing the contents, I came to know that it is not good.

Thanks for sharing the information guys. It was helpful. After reading through the RFE , I think what BCIS requires is a birth certificate from the local authority. If that is not available then they require a non availability certificate and 2 affadavits supporting the facts. The template that Sept13 has posted above is what they are actually looking for.

My folks are trying to locate the gram panchayat office to see if they have a record of the birth as the hospital was supposed to take care of that. Most probably that may not happen. So I think I will get the non availability certificate and the affidavits. The RFE mentions that the non availibility certificate has to be from a local authority. What classifies as a local authority ?

Your birth city's Municipal corporation is your local authority. It has to have signature from Birth and Death Registrar Officer's signature. There has to be a department of health for the village/city where you were born, this could be part of municipality or local govt.
