RFE for Birth Certificate. Please help !!!

I have received the following RFE for my BC details. Could someone please point me to a standard letter format which I should send to the INS. Do we have a format here on this forum. Please let me know :


Submit one additional statement, sworn to or affirmed by a person who was living at the time and who has personal knowledge of the events you are trying to prove, for example, the date and place of birth. The person making the statement (affidavit) may be your relative and need not be a citizen of the United States. However an affidavit written by you or the beneficiary is not acceptable. The affidavit should contain the following information regarding the person making the affidavit;

1) his/her full name and address;
2) his/her date and place of birth;
3)his/her relationship to you, if any;
4)full information concerning the event;
5) and complete details concerning how he/she acquired knowledge of the event.
6) The affidavit should address the facts concerning the birth of Puneet listing both parent's complete names.



I think I know what docs are needed. But I just want to make sure if there is a standard letter format for this type of RFE. Please let me know.

Puneet, Didn't you send the non-availability certificate and two affidavits(mother & father) while filing? (just wanted to know)

Below is the information that someone gave me when I filed I-485:


AFFIDAVIT IN LIEU OF BIRTH CERTIFICATE


I, <Mother's Name>, being duly sworn on the <Date>, depose and say that:

1. I am XX years old and reside at <address>.

2. I am the Mother of <your name>.

3. <your name> was born in the city/village of <name> in the district of <dist name>, in the State of <state>, India on the <your DOB>.

4. <your name> is the son/daughter of <father's name>, my husband.

5. I further affirm and state that the birth of my son/daughter <your name> was not registered and hence there is no governmentally issued Birth Certificate available.

I declare under penalty of perjury that the foregoing is true and correct.

Subscribed and sworn to before me this <date>.

Thanks Patcha_card !! I had submitted copies of my original BC alongwith 485 when it was filed. Maybe INS could not understand it correctly and need more affidavits to support it.

I already sent the following format to my folks at home :

AFFIDAVIT OF BIRTH BY MOHINA SHARMA
Re: Puneet Sharma

I, Mohina Sharma, hereby depose and say:
1. That I, Mohina Sharma was born on (birhtdate ) in the city of Delhi, India.
2. My full and complete address is (birthdate).
3. That I am closely related to Puneet Sharma. I am his Aunt (mother’s sister).
4. That Puneet Sharma was born on January 23,1972 at Army Hospital, Delhi Cantt (New Delhi), India.
5. The full names of his parents are Priya Sharma(mother) and Ram Gopal Sharma (father).
6. That I have direct personal knowledge of the event and circumstances concerning the birth of Puneet Sharma because I was present at the hospital during the time of his birth.
7. That I have known Puneet Sharma since he was born in January 1972.


I declare under penalty of perjury, that the foregoing is a true and correct statement.

For line 4 I had to put New Delhi in brackets because on my Birth Certificate it said Delhi Cantt under place of birth. Could this be a problem as INS may think it may not be a valid city ?

Please let me know if you think any changes need to be made to this format.

Puneet, That shouldn't be a problem and I think you got the right format.

One correction for line 2:

My full and complete address is (birthdate).

Make sure to fill in (address) instead of (birthdate)

One personal suggestion, please delete the post where you have mentioned all your personal particulars including date and place of birth, parent's name etc. Try to post messages as generic as possible without giving all your personal info. Thank You very much guys !! I will keep you informed once I submit the RFE response. I will also heed by your advice.
