RFE-Employment Letter after Layoff

Hi Immi Gurus,

I was laid off after 7 months from RD of 485, and after 11 months from RD, I got an RFE about the Employment Letter. I am currently contracting (Temporary Employee) with another company. Clearly, I need to make use of AC21, however, its not a permanent employment. Are there any restrictions under AC21, such as permanent employment, salary, or geographical with respect to the prev. employment ? Also, how is the current scenario of AC21 clearance ?

There is no such thing as permanent employment in USA

Employments are either part-time or full-time and within these categories employee or contractor. If you are contracting for a client with a paystub and w-2 from another parent company you should be fine.

If that were the case, you will have to make your parent company give you a letter with job description matching the one in your labor cetificate filing..and also saying they will employ you after your GC is approved.

Get in touch with a competent attorney who has already successfully handled such cases, immediately.
 
AC21 for Contracting

Can anyone pl. say, how is the success rate of AC21 in California Service Center, if you have changed the job in a similar work area (obviously after 180 days)? What precautions should be taken while taking advantage of AC21 ?
