RFE: email recieved but NOT the Physical mail contianing the RFE - please advise

Hi,

I received a mail from USCIS on July 14th 2007 indicating that they sent an RFE. However, my company lawyers told me that the physical mail contining the RFE is not received by them yet. It has been over a month by now. I am concerned about the RFE delivery.

Typically, how many days do I have to respond to the RFE once the RFE is mailed by USCIS?

I used to work for comapny A and them moved onto comapny B. Never informed USCIS about the change (as per comapny B's lawyers recommendation). My initial I-140 was filed and approved for the company A. I-485s were pending for company A. Then recently company B filed I-140 and simultaneously informed USCIS that they are taking over the pending I-485s (for me and my wife). This added one more parameter to the whole mix. I wanted to make sure that the RFE is not delivered to the laywers from the company A. I have sent an email to the company A lawyers as well asking if they recieved the RFE (I am yet to receive the reply). My company lawyers told me that the RFE will be delivered deirectly to them and not to worry.

Is any one in the same situation? Please advise.

Hey, I faced the same situation as yours. I called TSC (my case is with TSC) and asked them who is the attorney on record in their system. To my surprise it was my earlier attorney and not the current one (even though I filed G28). My advice would be to call NSC and talk to an IO to get the attorney on record. Don't wait.
 
forgot to add. My RFE was sent to the earlier attorney and not the current attorney. I eventually got my RFE mailed to my address by the old attorney.

To my surprise Immigration Officer said that they have the law firm used by the previous company on record. I have sent a request to the attorney from the previous employer to forward the RFE to me and also simultaneously I contacted the attorneys from my current employer to update the case with USCIS so that further communication goes through them.

I will keep updating this thread. It might help some one down the line.

Be very carefull until you receive the RFE on your hand. If you don't reply to the RFE at the right time, it will create problems. Usually its 2 weeks time
to get a notice. But it will not take that much time though.

I have contacted the NSC and the IO said that she would try to get the rfe re issued to my address but no guarantees. She aksed me to talk to my current lawyers and ask them to send a G28 (form for representation) immediately.

My new I140 from my current employer was sent to TSC where as my pending I485s are at NSC. I think this messed up the whole thing.
 
USCIS reissued the RFE as per my request. However the reponse deadline is still mentioned as August 15th. They posted it on 17th and it was received on 20th. Surprisingly they again posted it to the old lawyers address even through I requested it to be sent over to my home address.

My current lawyers are working on responding to the RFE.
 
Thank God. My lawyers indicated that they submitted the reponse daybefore yesterday. Now, God willing NSC should accept the RFE response and proceed with approval.

It reads as below:

Submit a currently dated letter or other evidence from your intended permanent employer, that indicates your current position, if any, your proffered position, the date you began and the proffered salary or wage. The letter must indicate whether the terms and conditions for the employement-based immigrant visa petition (or laber certification) continue to exist.

Important: If you have changed employers since filing your application for adjustment, the letter shall be issued by the new intended permanent employer. This letter must specify the job title and the duties of the proffered postion, the minimum educational and/or training requirements, the date you actually began employment and the offered salary or wage. This letter must be issued by an appropriate authority within the organization who is authoirized to make or confirm an offer of employment.

Additionally, if you have changed employes since filing your application for adjustment of status, please submit a statement which lists the names and locations of all employers you have had in the U.S. and the beginning and end dates of each position.

hey this is the same RFE that I had received after AC-21 and withdrawal of I140 by previous employer. pretty straightforward. don't worry abt this RFE. they are just confirming that you are still employed and you are in status.

I called up NSC to find out if the Attorney-On-Record has been updated. The I/O said that on record it still shows the old lawyers name. He also said that if the G-28 forms are submitted along with the RFE response, then probably it will be updated once they look at the RFE response. And also he confirmed that the application on its way to an officer.

God willing it should get approved soon.
