I had first applied for I-485 but had problem with my husband then and filled for divorce. After a year, I start a new I-485 with my current husband and has gone to the interview. We were asked to bring in DNA evidence for our baby that was two days old and a premature and was in the intensive care of the hospital at the day of the interview but we couldnt because we had financial prpblems, it costs 500 box for the test. However, we wrote a letter explaining our financial situation at the moment but we sent in the baby's birthcertficates that has our names. The office later wrote me after three months denying the first application with my ex.
Questions, Can the office make decision on the current application with first application, I mean, is it possible that they have responded to our application by responding to the first application?
secondly, can they deny our pettion because we did not give them the DNA eveidence evn we wrote a letter within the trime limit?.
Can we still send in the DNA eveidence?. It has been six months now since the request and the response and the interview .
