RFE concerns

Got layed off and was out of job for 3 months and then worked as a contractor for a couple
of months in the same job classification.

Now my present job is also of the job description as in my original
labor certificate.

What are my chances now since I would use AC21.
My lawyer is giving me a headache and is not being very co-operative about filing the RFE response

What should I do.

Bani,
can you clarify few more details - like have you rec'd a RFE ?
I don't why your lawyer is giving you tough time ?
what are you ND/RD ?

if you currently employed, have the similar job descirption , you will be fine.
what all are they asking in your RFE ?
Are they also asking for your 2003 W2 ?

what RFE u received? pls descirbe

forget ur Attorny and never depend on him... just submit FormG8 to either change attoreny or represent ur case urself .... I believe just change ur attorney or hire any attorney..... this is ur pettition.... not attorney's .. so stop worring about his co-opp.... and start thinking to response RFE....

explain ur situation clearly ..... u will get idea..... from many ppl

Good Luck.

Outsource his job

No wonder the lawyers jobs are being outsourced.
It is now 3 weeks since the EVL RFE was received by my attorney.
And still they cannot file. They tell me "we have 90 days to respond" etc etc have f' relax we are working on your case.

Such kind of nin-kampufs should have their jobs outsourced.
to China or India where people work faster and cheaper and efficiently.

I am so upset with these guys.

outsource nin-kampufs

The attorney is company appointed and the EVL RFE went directly to him.
Every day the guy wants new supporting documents
and does not understand the urgency here.

I understand that......

is that ur previous empl 's Att or its new Empl 's Att?

when u switched job? after approval of LC and 140 ????

at that time was ur 485 pending ? and u waited 180 days ?

is he new empl's attorney then how he received RFE?

485 is submited as individual basis........ Empl have to do nothing with that. u can use AC-21 anytime after 180 days pending 485. its good to stick with old Empl. its up to u

share the full story so could understand. what is going on.

Bani,

I understand your frustration as I also went for almost 4 weeks. I got RFE 02/05/04 and it was just EVL and the lawyer took almost 3 weeks to prepare that and which is almost similar to the letter that we filed during I140 (Modifie a couple of lines) and I used to follow up almost 3 - 4 times daily and unfortunately most of the time they neither responded my calls nor my e-mails.

It is very big pain to work for big corporations as they hire big law firms and they are good for nothing. Unfortunately we normally get "NO CUSTOMER SUPPORT" and no accountability.

My advice for you is just follow up with them as many times as you can and never lose your temper and take it to your HR /Immigration dept and to your manager and some times it might work. Also tell them that you almost waited so and so years and TSC processing pretty fast now and If for some reason they stop (I hope not) then you will be again victimized for the delays.

All the best
